Riding in the Back of a Pickup Truck is Dangerous – and Sometimes Illegal

car crashed onto a pick up truck | Riding in the Back of a Pickup TruckRiding in the back of a pickup truck is dangerous. Unlike passengers inside the truck, there are no steel frames, airbags, or safety belts protecting riders from harm. In an accident, passengers riding in the back of a pickup truck can be thrown from the vehicle and into other objects or into oncoming traffic. They can even be harmed when accidents don’t occur. Simply slamming on the brakes or swerving suddenly to avoid a pedestrian or animal on the road can be life-threatening.

In Colorado, there is no law that prevents adults from riding in the back of a pickup truck, provided they are sitting in the cargo area only. Adults are not allowed to ride on the top, hood, or fender of any other portion of a vehicle. If they’re caught doing so, they can face a fine – however no points are assessed. Children are required to stay in safety seats until the specified age limits. Colorado law requires:

  • Infants under one year and less than 20 pounds must ride in a rear-facing child safety seat
  • Children ages one to four years old that weigh at least 20 pounds up to 40 pounds to be restrained in a forward-facing or rear-facing child safety seat
  • Children at least 4 years old and weighing over 40 pounds must be properly restrained in a child booster seat or with a child safety belt-positioning device
  • Children must ride in booster seats or safety belts until they are eight years old

Sadly, according to the Children’s Safety Network, every year, 50 young adults and children under the age of 21 are killed while riding in the back of pickup truck. Half of all truck bed accident deaths are children and teenagers.

Are you Partly to Blame for the Accident?

If you are riding in the back of a pickup truck and you are injured in an accident, you may bear some of the responsibility for your injuries. If the courts determine that the severity of your injuries are partly your fault, then you may recover fewer damages after the accident. As such, it is important to have an experienced and skilled Colorado truck accident attorney on your side from the very start. Your attorney will need to build a case to show negligence and help you collect the compensation you need to recover after a serious accident.
